The Court hereby finds, upon request of the Chapter 13 Standing Trustee,
that the minimum costs of the administration of a Chpater 13 case in which
no plan is confirmed is not less than $50.00. A schedule of estimated minimum
per case costs is attached hereto as Exhibit A.
NOW, THEREFORE, IT IS HEREBY ORDERED AS FOLLOWS:
1. In any Chapter 13 case which is dismissed or converted to another chapter prior to confirmation of a Chapter 13 Plan, the Chapter 13 Standing Trustee shall be allowed, from preconfirmation payments by the debtors, at least the sum of $50.00 as an award of expenses pursuant to 11 U.S.C.§§ 1326(a) (2) and 503(b).
2. Notice of the proposed award shall be given to the debtor, debtor's attorney and the U.S. Trustee by disclosure in the Trustee's Final Report and Account.
3. If the trustee determines that a larger reimbursement of expenses is appropriate he shall itemize the expenses for which reimbursement is sought and give notice to the debtor, debtor's attorney and the U.S. Trustee.
