June 18, 2013 Bench-Bar Meeting Moved to July 16, 2013

The Court hearings calendar that had been originally scheduled for Tuesday, June 18, 2013, has been moved to Friday, June 14, 2013. The Vermont Interactive Technologies sites will be available for the June 14 date. The Clerk.s Office will issue notices rescheduling any hearings already set for June 18. Attorneys and their clients will begin receiving those notices soon. The Bench-Bar meeting originally scheduled for Tuesday, June 18, 2013, has been moved to Tuesday, July 16, 2013 at noon in Rutland.
13-102 April 4, 2013 Fee for filing Transfers of Claim beginning May 1, 2013

Please note that beginning May 1, 2013, there will be a $25 fee to file a Transfer of Claim with the Court.
13-101 January 8, 2013 February 5, 2013 Hearing Calendar Moved to February 19,2013

The Court calendar that had been originally scheduled for the afternoon of Tuesday, February 5, 2013 has been moved to the afternoon of Tuesday, February 19, 2013. That means we will be holding two court sessions on February 19. There will be a motion calendar with Vermont Interactive Technologies in the morning and an afternoon chapter 13 hearing session. Vermont Interactive Technologies will not be available for the afternoon hearings.
12-02 March 21, 2012 Relocation of Bankruptcy Court Clerk's Office to U.S. Post Office and Courthouse Building, Rutland, Vermont

Effective Monday, March 26, 2012, this court's clerk's office will be located on the fourth floor of the U.S. Post Office and Courthouse building at 151 West Street in Rutland, Vermont.
12-01 March 5, 2012 Public Access to Court Electronic Records (PACER) Fee Increase, Effective April 1, 2012

Effective April 1, 2012, the PACER fee will increase from eight cents ($0.08) per page to ten cents ($0.10) per page and the maximum for any one document or digital audio recordings will increase from $2.40 to $3.00.
11-07 October 31, 2011 Availability of Digital Audio Recordings on PACER Extended to All Hearings and Trials

Effective November 1, 2011, digital audio recordings will be available on PACER for all hearings and trials conducted on or after that date.
11-06 October 26, 2011 Fee Increases

Effective Tuesday, November 1, 2011, many of the fees for filing documents or obtaining services from this and other United States courts will increase. For most items this is the first fee increase in eight years. Refer to Bankruptcy Court Fees for the new fee amounts.
11-05 September 30, 2011 Access to older bankruptcy case documents

In September 2010, the Judicial Conference amended a policy on privacy and public access to electronic case files to restrict public access through PACER to documents in bankruptcy cases that were filed before December 1, 2003 and have been closed for more than one year. Certain constraints in this court's CM/ECF system did not allow implementation of the policy at the time. Recent CM/ECF upgrades now allow implementation.
11-04 August 11, 2011 Court to Begin Operating under CM/ECF Release 4.1 to Include Payment of Fees via Pay.Gov

On August 22, 2011, the court is scheduled to begin operations under Bankruptcy CM/ECF Release 4.1. Release 4.1 introduces new requirements for password security and a new user interface. Release 4.1 will also support an additional noticing-related improvement provided by the court.s Bankruptcy Noticing Center (BNC) contractor. Finally, in conjunction with the update to CM/ECF Release 4.1, the court will begin collecting fee payments online using a built-in application called Pay.gov.
11-03 April 14, 2011 Digital Audio Recordings of Motion Calendar Hearings Will Be Available on PACER Beginning May 1, 2011

Due to recent enhancements to the case management/electronic case filing system (CM/ECF) and the approval of the Judicial Conference of the United States, effective May 1, 2011, digital audio recordings of court hearings will be made available on the court docket through the Public Access to Court Electronic Records system (PACER) for a fee of $2.40.
11-02 April 14, 2011 New Procedure for Chambers Pre-Trial Conferences

Effective immediately, the Court will hold pre-trial conferences in chambers, upon the request of counsel and in such instances where the Court deems it will expedite litigation of an adversary proceeding or contested matter.
11-01 February 3, 2011 Updated Vermont Local Bankruptcy Form Y-8 Wage Withholding Authorization/Consent to Automatic Debits from Bank Account Effective Immediately

Based on feedback from the Bar and Standing Chapter 13 Trustee, the Court has revised Form Y-8 to include a consent to Automatic Debits from Bank Accounts for debtors who are not able to authorize direct wage withholding because they do not have income from an employer. This change will eliminate the necessity of filing a motion to waive the wage withholding requirement when the debtor does not have income from an employer.
10-02 December 20, 2010 Courtroom and public use computer terminals, access now limited

Recently we were required to reconfigure the courtroom litigant table computers and the public use computers in the bankruptcy court's Rutland and Burlington locations to comply with new national requirements. This will have a rather significant impact on your use of these terminals, effective immediately. Under the new configuration, the terminals allow access only to the U.S. Court's website, the Vermont Bankruptcy Court's Case Management/Electronic Case Filing (CM/ECF) website, and this court's Internet website (www.vtb.uscourts.gov).
10-01 June 24, 2010 Calculation of response deadlines when using default procedure

This Clerk's Announcement is designed to encourage filers when using the default procedure to select response deadlines closer to the earliest possible date that complies with notice requirements rather than the latest possible date. This will result in matters being resolved quicker, which should give all parties more certainty earlier in the process as to the need to appear in court over a particular matter.
09-02 November 24, 2009 Changes to Federal Rules of Civil Procedure and Official Bankruptcy Forms Effective December 1, 2009

Among the time-computation amendments to the Federal Rules of Bankruptcy Procedure that will take effect on December 1, 2009, are changes to 12 rules that will result in a reduction by one day (from 15 to 14 days) of the time to take action.
09-01 August 14, 2009 Scanner Settings for Documents filed via CM/ECF

By October 1, 2009, the scanner setting for documents filed with this court must be at a resolution of 300 pixels per inch (ppi) or higher, rather than at 200 ppi as we had previously suggested. Using the 300 ppi setting will help ensure archival quality of electronically filed documents.
08-03 December 11, 2008 Digital Audio Recording and Transcripts

Effective January 1, 2009 the court will no longer supply court reporters for hearings and trials. A digital audio recording will be taken of all court proceedings. This annoucement provided information on ordering transcripts.
08-02 December 11, 2008 Change to Form VTB O-2, Motion for Entry of Discharge, Chapter 13

This change is to make the language of our local form mirror the language of the Director's Procedural Form B283, Chapter 13 Debtor's Certifications Regarding Domestic Support Obligations and Section 522(q), effective December 1, 2008.
08-01 October 9, 2008 CM/ECF Version 3.2 Implementation

Due to performance issues experienced by other courts and upon the recommendation of the Administrative Office of the United States Courts, this upgrade has been postponed until the cause can be found and the software corrected.

Over the weekend of October 18-19, 2008, the U.S. Bankruptcy Court, District of Vermont will upgrade CM/ECF to Release 3.2. There will be several substantial changes to the way CM/ECF looks and works. This Clerk's Announcement provides important information about the upgrade.

In an effort to utilize video conferencing technology, the Court has consolidated motion calendar days by making the several changes to the Hearings Calendar for the months of July, August and September.
06-104 December 12, 2006 Changes to Miscellaneous Bankruptcy Fees - Effective January 1, 2007.

On September 19, 2006, the Judicial Conference approved several changes to the Bankruptcy Court Miscellaneous Fee Schedule relating to implementation of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) and the Deficit Reduction Act of 2005 (DRA).
06-103 October 19, 2006 Revised Director's Procedural Forms: Form 104, Adversary Proceeding Cover Sheet (Exhibit A); and Form 210 Transfer of Claims Other than for Security (Exhibit B). The two revised forms are effective immediately.
